Our Services to Borrowers in New Zealand

Mortgages have become a commodity. Although mortgage lenders are often viewed as parties in the chain that supplies this commodity, a mortgage is nevertheless a legal instrument and lawyers too play an important role in the mortgage supply chain.

If a lawyer is required to supply a commodity, then the lawyer’s services should be delivered as efficiently and cost effectively as possible.

In New Zealand, lawyers have come to expect to be instructed by lenders to act for the lender as well provide legal advice to the borrower. The Courts, the rules of professional conduct and common sense tells us that this has the potential to create a conflict of interest – particularly when the lawyer should be advising the borrower to do something that may not be in the best interest of the lender.
